Post-Employment Covenants and Economic Losses

Abstract

Currently, only a small fraction of post-employment covenants result in court intervention. However, the literature suggests an increasing propensity of employers to require these agreements. The predicted result is a high frequency of breaches and consequent requirements to value alleged business losses. This paper explores some of the practical implications of this scenario.
