Book Review: Duff, Farmer, Marshall and Tadros, The Trial on Trial (vol. 3): Towards a Normative Theory of the Criminal Trial

Abstract

This volume, as with the earlier two in the series, is the product of a major research project. It is a well-executed and accomplished work. Arguments are elaborate and carefully constructed. The book starts with an historical tour, proceeds to normative theorizing of the criminal trial, and moves on to an application of the proposed theory and exploration of its implications. Not everyone will be persuaded by the authors and some may even disagree strongly with them on certain claims. It is a rich source of insights, filled with ideas that have tremendous potential; if nothing else, readers are forced to re-examine conventional assumptions about the criminal trial. For achieving that alone, the authors are to be congratulated.
