ABSTRACT:
This paper is a collection of nine articles on the Economic Analysis of Public Law – a field which has to some extent been neglected in the Law and Economics literature in Germany. Part I contains five papers addressing methodological issues: normative foundations of the Economic Analysis of Law; the notion of consensus in contract theories and discourse theories; cost-benefit-analysis in public law; the notion of rationality in institutional economics; a comparative discussion of hermeneutic and economic methods. The four contributions in Part II apply economic methods on topics of international and German Public Law: Constitutional Economics and the law of the GATT/WTO; Constitutional Economics and European federalism; criteria for EC decision making in different stages of European integration; economic analysis and German tax law.
