Abstract

This essay on the Europeanisation of Private Law emphasises the fact that the Europeanisation is a making process rather than a societal developing process. The outcomes of the making process lie beyond the known coordinates of the national legal systems. The legal provisions for a unified or harmonised European Private Law are virtually orbiting the existing legal world. The question 'how this builds up to a consistent legal system' will - with or without the pedagogy of complexity (Delmas-Marty) - find an answer that surpasses all ordinary building types.
