Abstract

This article describes solutions offered by the White Paper in the European context. It addresses the liability regime, damages, standing, evidence, causal links and insurability of environmental risks. It also discusses possible approaches to implementing options produced by the White Paper (directive, recommendation). Finally, the paper highlights the difficulties which the European debate creates for Italian lawmaking, as well as the opportunities it offers.
